1. Who we are, and what these Terms cover
1.1 Paspartou is operated by Paspartou App Limited, a private company incorporated in the Republic of Mauritius (company file no. C238927, business registration no. C26238927), with its registered office at Old Moka Road (L. Baden Powell Avenue), Trianon, Quatre Bornes, Republic of Mauritius (“Paspartou”, “we”, “us”).
1.2 These Terms apply when you create a Paspartou account and when you use the Paspartou mobile app or the customer web portal. By creating an account you accept these Terms.
1.3 How we handle your personal information is explained separately in our Privacy Policy, which you accept at the same time.
1.4 We may publish these Terms in English, French and Kreol Morisien. If the versions differ, the English version prevails.
2. What Paspartou does
2.1 Paspartou is a digital loyalty wallet. It replaces the paper stamp cards you would otherwise carry for individual shops.
2.2 Each participating business runs its own loyalty programme and decides its own rules — how you earn, what you can claim, and whether what you earn expires. We operate the technology that records it.
2.3 Important: the rewards are the shop’s, not ours. We record what you have earned. The business you earned it with is the one that gives you the reward. We are not the seller of any product or service you obtain with your points or stamps.
2.4 Using Paspartou is free for you. There is no charge to hold an account, earn, or claim a reward.
3. Your account
3.1 You need a Mauritian mobile number to open an account. You confirm the number belongs to you.
3.2 You must be at least 16 years old to hold a Paspartou account. If we learn that an account belongs to someone younger, we will close it and delete its data.
3.3 If you are 16 or 17, you may use Paspartou in the same way as any customer, with these extra protections:
- We never send you marketing messages, even if you have ticked the marketing box.
- A parent or guardian may contact us at hello@paspartou.com on your behalf, including to ask for your account to be deleted.
- Clause 11 of our Privacy Policy explains how we protect your information.
When you turn 18, these extra protections stop. You can then choose to receive marketing, and we will not send it unless you choose to.
3.4 You sign in with your mobile number and a one-time code sent by SMS. After that, you unlock the app with a PIN you choose, or with your fingerprint or face if your phone supports it. There is no password.
3.5 Keep your PIN to yourself. Anyone who has your phone and your PIN can use your account.
3.6 Tell us straight away if your phone is lost or stolen, or if you think someone else is using your account. You can also remove a device yourself from the app at any time, which stops that device being used.
3.7 One person, one account. Opening more than one account — for example to claim a joining bonus more than once — is not allowed and may lead to your account being suspended.
3.8 You are responsible for what happens on your account, unless someone used it without your knowledge and you told us as soon as you realised.
4. Using Paspartou in a shop
4.1 You show the QR code in your app. The shop scans it and records what you have earned.
4.2 To claim a reward you must be in the shop, and a member of their staff confirms it on their device. You cannot claim a reward from the app on your own.
4.3 Earning: if the shop’s device cannot connect to the internet at that moment, it may record what you earned and send it once it reconnects. It will then reach your balance shortly afterwards.
4.4 Claiming a reward always needs a connection. A reward cannot be claimed while the shop’s device is offline.
4.5 Your QR code identifies you. Do not share a screenshot of it, and do not let anyone else use it.
5. Points and stamps
5.1 Points and stamps are not money. They have no cash value, cannot be exchanged for cash, and cannot be sold, given away or transferred to anyone else.
5.2 They only work at the shop where you earned them. Points and stamps earned at one business cannot be used at another, and cannot be combined across businesses. Every balance is separate.
5.3 How you earn — per visit, per amount spent, or per item — is set by the shop, and the amount is calculated by our system from the rules that shop has chosen. The shop’s staff cannot change the amount by hand.
5.4 Some shops give a joining bonus the first time you use Paspartou with them.
5.5 A shop may set an expiry period. Where it does, the app shows you the expiry rule for that shop, and we notify you in advance of points or stamps that are about to expire. Where a shop sets no expiry, nothing expires.
5.6 A shop can change its programme. Anything you have already earned stays in your balance. If a change reduces what your existing balance can obtain, we will tell you.
5.7 If something is recorded in error, it is put right by adding a correcting entry rather than by editing the record. Your history therefore shows both the mistake and the correction.
5.8 If a shop leaves Paspartou — because they close, or their agreement with us ends — that shop must continue to honour what you have already earned for at least thirty days, and we will tell you so that you have a chance to use it. After that period we cannot require them to do so.
5.9 We are not responsible for the quality, safety or suitability of anything a shop gives you as a reward. That is a matter between you and the shop.
6. Messages we send you
6.1 We send you SMS one-time codes when you sign in on a new device. These are necessary to use the service and cannot be turned off.
6.2 We send notifications about your account — points earned, a reward unlocked, points about to expire. You can turn these off in the app.
6.3 Marketing messages are separate. We only send them if you have specifically agreed, and you can withdraw that agreement at any time without losing access to anything else. We never send marketing to customers under 18 (clause 3.3).
7. Things you must not do
7.1 You must not:
- open more than one account, or use someone else’s
- try to earn points or stamps other than by a genuine purchase or visit
- arrange with anyone to record transactions that did not happen
- copy, share or sell your QR code
- attempt to interfere with, probe or misuse the app or our systems
- use Paspartou for anything unlawful
7.2 We monitor for patterns that suggest misuse. Where we find them we may investigate, contact you, or suspend an account. Suspension decisions are reviewed by a person, not made automatically.
8. Availability and support
8.1 We try to keep Paspartou working at all times but cannot promise it will never be unavailable.
8.2 We may change or remove features. Where a change significantly affects how you use the service, we will tell you.
8.3 You can reach us on the support number shown in the app, which is available without signing in.
9. Deleting or suspending an account
9.1 You may ask us to delete your account at any time. In the app, go to Settings and choose Delete my account. If you no longer have the app, use the instructions at paspartou.com/delete-account. A member of our team completes the deletion within 7 days.
9.2 Once your account is deleted, any points and stamps you hold are lost and cannot be restored. Use them before you ask.
9.3 What we delete, and what we keep and why, is explained in clause 8 of our Privacy Policy.
9.4 If you also run a shop on Paspartou, your account is tied to your shop’s signed agreement and invoices. We will contact you to agree how the shop is closed before your account is deleted.
9.5 We may suspend or close your account if you seriously or repeatedly break these Terms, if we reasonably believe your account is being used fraudulently, or if we are required to by law. Where we can, we will tell you first and explain why.
9.6 If we close your account without good reason, and you held points or stamps, we will work with the shops concerned to give you a reasonable opportunity to use them.
10. Our responsibility to you
10.1 Nothing in these Terms limits our responsibility for fraud, for death or personal injury caused by our negligence, or for anything that cannot lawfully be limited.
10.2 Subject to clause 10.1, we are not responsible for a shop failing to honour a reward, for the quality of what a shop provides, or for a shop closing.
10.3 Subject to clause 10.1, we are not responsible for losses that were not reasonably foreseeable, or for business losses, as the service is provided to you for personal use.
10.4 If we record your balance incorrectly through our own error, we will correct it.
11. Changes to these Terms
11.1 We may change these Terms. Where a change materially affects your rights we will tell you in advance and ask you to accept the new version.
11.2 Each version is dated, and the version you accepted is recorded against your acceptance. You can ask us for a copy of the version you agreed to.
11.3 If you do not accept a new version, you may ask us to delete your account. Clause 9.2 applies.
12. General
12.1 If any part of these Terms cannot be enforced, the rest continues to apply.
12.2 These Terms are governed by the law of the Republic of Mauritius, and the courts of Mauritius have exclusive jurisdiction.
